Injury through Medical Malpractice

Medical Malpractice is an international problem, that seems to be taken seriously once it comes to the US. People say that one of the reason is that there are just more cases reported in the United States than in other country.  Europe and Canada both have departments set aside to research, explore, and defend all medical malpractice lawsuits and their healthcare systems tend to be more cohesive, more patient friendly, which reflect the numbers of medical malpractice cases. In short there are less cases of invasive surgeries, less cases being overlooked and less cases of elective surgeries.

A Regional Approach

First, we need to be clear, medical malpractice isn't just doctors making mistakes in the operating room. Medical malpractice also goes under the umbrella of neglect and misdiagnosis in some countries.

The Philippines

The Philippines is really tough on their doctors. Once a doctor is proven guilty, they face fines, inspections, and monitoring to ensure that it won't happen again. If it's a repeat situation, they won't allow the doctor to practice any more. So chances are that may have lower incidents because they have lower tolerance.

Canada and the UK

Both countries have a board that oversees the practices of all doctors. Before a file is sent to court, the case is reviewed by by the board. If they see that there is a claim or that the complaint is justified, they allow it to go to court. Doctors are basically marked. It has to be declared as public knowledge once they are found guilty. In Canada, the winning party has to an extent pay part of the losing party's legal fees in addition to any thing the court requires for the case. Thus in turn, it keeps the unnecessary law suits under check and control.

Medical Malpractice and Options

If you are a victim of medical malpractice, you should not be afraid to report the case. Medical malpractice is not fair. It can be avoided and it needs to be done away with completely. If you would like to receive legal help and support for medical malpractice, your rights, or how to file then you should seek out a team that you can trust to give you honest legal advice.

When you speak out about a doctor who has mistreated you or a dear one, then you have a responsibility to act against him. You will need a team that understands medicine and the legal steps that you can take. Most often, you are not alone in your fight. When one victim has the strength to come forward, many others begin to follow. Don't let a personal injury case caused by medical malpractice get the better of you due negligence.
