If the person got injured badly, then there is a chance of penalty.   If you can settle the case with the help of lawyers, that will be good.

The fact is your friend was drunk. So here in Canada, it is a serious offence. Sometimes you can be convicted and burdened with a criminal record or your license may get suspended.

My brother faced a similar situation and we were able to deal the situation with the help of drinking and driving lawyers.

I am not sure about the rules of Indiana. It is better you seek a legal assistance so there is a possibility of negotiation. Hope the information can help you. Thank you.

Was the driver injured badly? You also know that it was your friends mistake that he was not following the rules and was drinking and driving. But if he has accepted his mistake and his ready to pay for the driver's medical bill then yes, he should definitely take reference from a lawyer to keep his point. An attorney will provide him a legal representation and support throughout the case buy using their knowledge and experience.

My friend was driving home after meeting up with a friend for some drinks. He only had two beers, but wasn't a particularly large man and hadn't eaten lately, and the effect was noticeable on him. Still, feeling confident that two beers wouldn't incapacitate him, he said goodnight to his friend and drove home. On the way home, his cell phone slid out of his pocket and under the seat. He glanced down to see where it had fallen and by the time he looked up it was too late; his car pushed another car. The driver on the other car was injured.
Now, my question is what should be his next step? Hiring an attorney? or what?

The event took place in Indiana.
